Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the JohnnyScales Marketing website and your engagement of advertising management services from JohnnyScales Marketing ("JohnnyScales," "we," "us," or "our"), based in Licking County, Ohio. By using our website or engaging our services, you agree to these Terms.
2. Services
JohnnyScales provides Facebook and Instagram advertising management services, including strategy, campaign setup, creative direction, budget management, testing, and reporting. The specific scope of services will be agreed upon directly between JohnnyScales and the client prior to commencement of work.
3. Client Ownership
Clients retain ownership of their advertising accounts, advertising data, audience data, and creative assets at all times. JohnnyScales acts as a service provider with access necessary to perform agreed-upon services and does not claim ownership over client accounts or data.
4. No Guarantee of Results
While JohnnyScales works to deliver qualified leads through paid advertising, advertising performance is influenced by many factors outside our control, including platform algorithms, market conditions, and the client's own business practices. JohnnyScales does not guarantee specific results, lead volume, or return on ad spend.
5. Fees and Payment
Service fees, billing frequency, and payment terms will be set out in a separate agreement between JohnnyScales and the client. Advertising spend paid directly to Meta platforms is separate from and in addition to any service fees owed to JohnnyScales, unless otherwise agreed in writing.
6. No Long-Term Lock-In
JohnnyScales does not require clients to commit to lengthy, non-cancellable contracts. Specific cancellation terms and notice periods will be detailed in the client's individual service agreement.
7. Client Responsibilities
Clients are responsible for the accuracy of information provided, for complying with all applicable advertising laws and platform policies relevant to their industry, and for handling leads generated through their advertising campaigns in a timely and professional manner.
8. Limitation of Liability
To the fullest extent permitted by Ohio law, JohnnyScales shall not be liable for indirect, incidental, or consequential damages arising from the use of our services, including lost profits or lost business opportunities. Our total liability for any claim shall not exceed the fees paid by the client for the service giving rise to the claim.
9. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ohio.
10. Changes to These Terms
We may revise these Terms from time to time. The most current version will always be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
